The Air District developed new Regulation 13: Climate Pollutants, Rule 5: Industrial Hydrogen Plants (Rule 13-5) to address emissions of methane (a potent climate pollutant) and volatile organic compounds (a precursor to smog formation), which together are referred to as "total organic compounds" (TOC), in the Bay Area. The Air District also developed amendments to Regulation 8: Organic Compounds, Rule 2: Miscellaneous Operations (Rule 8-2), as part of the rule development process, to align applicability and exemptions with new Rule 13-5, and to update other provisions to be consistent with other recently amended rules.
At a public hearing held on May 4, 2022, the Air District Board of Directors adopted Proposed New Rule 13-5 and Proposed Amendments to Rule 8-2, and certified the Final Environmental Impact Report pursuant to CEQA.
